In cases where there is a dispute over whether a trade union has the right to represent the staff of an employer for collective bargaining purposes, the Trade Dispute Panel (TDP)

Conciliation is the process of reaching an agreement through a process of negotiation.

Arbitration is the step after conciliation and takes place when negotiations fail to reach an amicable settlement between employers and employees.

Any party affected by a decision of the Trade Disputes Panel through its granting of an award may apply to the TDP to have the decision reviewed in accordance with Section 10 of the Trade Disputes Act 1981 {link to Act}

Decisions of the Trade Disputes Panel in the form of an award, is enforceable by law.
