Trade Dispute Process

  • Convening of a TDP hearing
    • After a notice of hearing is issued by the Secretary to the TDP and a hearing is listed for the Trade Dispute Panel, a sitting is convened to hear the dispute between the parties (arbitration).

 

  • Quorum to hear cases

A sitting of the Trade Dispute Panel requires a basic quorum of three panel members including the TDP Chairman or the Deputy Chairman in the Chairman’s absence.

  • Further information
    • The Trade Dispute Panel may still convene a hearing into a trade dispute case with a minimum quorum of two panel members including the Chairman (or the Chairman’s Deputy). This is as long as the parties to the dispute give their consent for a hearing to be conducted in the absence of a member in accordance with section 4(2)(b) of the Trade Dispute Act 1981 (Cap 75).
  • Draft award sent to Minister for varying
    • The Trade Dispute Panel has a period of 21 days from the day a hearing into a trade dispute case begins, to come up with a draft award to present to the Minister of Commerce for varying purposes.

 

  • Minister’s power to vary awards (Section 8 of Trade Disputes Act)
    • On receiving a draft award, the Minister will have 7 days to vary that award and state the reasons for such variance. If no variance is made after 7 days have lapsed, the draft award shall be the final award.
