Trade Dispute Process

o   Documenting a final award

o   After a draft award described in Step 4 {link to Step 4} is varied or upheld, the award will come into effect and its terms will be recorded in a document in accordance with Rule 8 (1) of the Trade Disputes Panel Rules.

 

o   Chairman endorses Panel decision

 

o   The written decision will be signed by the Chairman of the TDP and handed to the Secretary of the TDP who will then send copies of the decision to the conflicting parties.

o   In cases where the written decisions (awards) of the TDP are to be used as evidence in a separate proceeding; a copy of the award certified by the Secretary to the TDP will be admissible as evidence in such proceedings.

  • Making an appeal to the High Court
    • Decisions or awards of the Trade Disputes Panel can be appealed in the High Court.

 

  • Who can appeal?
    • Either party to a trade dispute may appeal a TDP decision at the High Court in accordance with section 13 of the Trade Disputes Act (Cap 75).

  • Further information
    • Order 60 of the High Court (Civil Procedure) Rules 1964 shall apply with the necessary modifications to appeals made under section 13 of the Trade Disputes Act as it applies to civil appeals against an interlocutory decision of a Magistrates' Court.
